The use of our services and/or the purchase of our products implies that you have read and accepted these Terms.
Some of the products offered on our website may be created, charged, shipped or presented by a third-party website and in such cases would be subject to their own Terms and Conditions.
In some cases, to purchase a product, user registration will be required, with the entry of accurate personal data and the definition of a password. The user may choose and change the access key for their account management at any time, should they have registered and it is necessary for the use of any of our services. VOIPER TELECOM SL assumes no responsibility if such key is passed to third parties.
All transactions carried out through this website are subject to a confirmation and verification process, which may include payment method validation, invoice validation (where applicable) and compliance with the conditions required by the selected payment method. In some cases, verification via email may be required.
The prices of the services offered on this website are valid only for subscriptions made on the same website.
Licence
VOIPER TELECOM SL, through its website, grants a licence for users to use the services offered on it in accordance with the Terms described in this document.
Unauthorised Use
VOIPER TELECOM SL grants the user a limited, personal and non-transferable licence to use the VoIP telephony services and platform. The resale, redistribution, sublicensing or transfer to third parties of services, telephone numbers, SIP extensions or any other resource assigned to the customer is expressly prohibited without prior written authorisation from VOIPER TELECOM SL.
Intellectual Property
The content, design, source code, trademark, logo and other elements of the VOIPER TELECOM SL website are the property of VOIPER TELECOM SL or its licensors and are protected by Spanish and international intellectual and industrial property law. Reproduction, distribution, public communication or transformation without prior written authorisation is expressly prohibited.
Refund Policy and Warranty
VOIPER TELECOM SL services are provided as a SaaS (Software as a Service) subscription. The user may exercise the right of withdrawal within 14 calendar days of contracting, provided the service has not yet begun. If the user expressly requests that the service commence during the withdrawal period, they waive this right in accordance with art. 103.m of Spanish Royal Legislative Decree 1/2007 (TRLGDCU).
Outside the withdrawal period, no refunds will be made for already-invoiced subscription periods. Subscriptions may be cancelled at any time, taking effect at the end of the current billing period, during which the service remains active.
- 1.The right of withdrawal must be exercised in writing to info@voiper.es within the 14 calendar day period from contracting.
- 2.Number portability costs incurred are non-refundable.
- 3.Custom configuration, integration or deployment services are non-refundable once completed.
In the event of service outages or failures attributable to VOIPER TELECOM SL, the compensation regime set out in the specific service conditions and in Spanish Law 11/2022 on Telecommunications shall apply.
Limitation of Liability
To the extent permitted by applicable law, in no event shall VOIPER TELECOM SL be liable for indirect, punitive, incidental, special, consequential or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or related to the use or inability to use the service.
To the extent permitted by applicable law, VOIPER TELECOM SL assumes no liability for:
- •Errors, mistakes or inaccuracies of content.
- •Personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service.
- •Any unauthorised access to or use of our servers and/or any personal information stored therein.
Anti-fraud Check
The purchase/subscription may be delayed for anti-fraud verification reasons. It may also be suspended for a longer period in cases where a more rigorous investigation is required to prevent fraudulent transactions.
Privacy
VOIPER TELECOM SL guarantees that the personal information provided by the user will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD). Data may be communicated to third-party companies providing services necessary for the development of the activity, as detailed in the Privacy Policy.
Subscription to advertising email newsletters is voluntary and may be selected when creating your account.
Right to Modify the Legal Notice and Terms of Use
VOIPER TELECOM SL reserves the right to modify these terms without prior notice. Therefore, it is recommended to review these pages periodically. When the Legal Notice and Terms of Use are materially modified, notification of the important changes will be sent via the email address provided, with 30 days' notice before the new terms take effect. Continued use of the website or our service after such change constitutes your acceptance of the new Legal Notice and Terms of Use.
Governing Law and Dispute Resolution
This Legal Notice and Terms of Use are governed by Spanish law. For business relationships (B2B), any disputes are submitted to the Courts of Málaga. For users acting as consumers (B2C), the consumer's domicile jurisdiction shall apply in accordance with Spanish civil procedure law and consumer protection regulations.
